1. Scope of application
   1. We are committed to safeguarding the privacy of our website visitors, service users, individual customers and customer personnel.
   2. This policy applies where we are acting as a data controller with respect to the personal data of such persons; in other words, where we determine the purposes and means of the processing of that personal data.
   3. We use cookies on our website. Insofar as those cookies are not strictly necessary for the provision of our website and services, we will ask you to consent to our use of cookies when you first visit our website.
   4. In this policy, "we", "us" and "our" refer to Furlan Marri SA. For more information about us, see Section 14.

1. Offer and conclusion of the contract
   1. The presentation of the products in the online shop only represents an invitation to order and does not constitute a binding legally offer.
   2. The products descriptions on our Website are only approximate and product images are for illustrative purposes only. While we make every effort to be as accurate as possible on our Website regarding products descriptions (including, without limitation, size, weight, capacity and dimensions) and to display the most accurate colours, any description is only approximate and we cannot guarantee that the colours displayed on our site reflect the exact colour of the products.
   3. By clicking on the order button, the Customer undertakes to purchase all products listed on the order page.
   4. All orders are subject to acceptance by Furlan Marri. Orders are considered as accepted once Furlan Marri communicates them to the shipment company. For direct order, orders can only be cancelled for a full refund within 10 hours after the order. For pre-order products, orders can only be cancelled for a full refund until the end of the pre-order period. Cancellation will not be possible after this step, but customers have a right to withdraw as described below.
   5. All products presented on our website are subject to availability. If the product you have ordered is not available, we will inform you by e-mail as soon as possible and Furlan Marri will offer you (i) to secure payment for shipment for the next available batch, if any, or (ii) to be notified once the watch is back in stock.
   6. Online sales via the Website are intended for end consumers of the products, not for resellers. Furlan Marri may at its sole discretion refuse an order if they suspect the purchaser is acquiring the products for resale.
   7. 2.8 Customers shall comply with all applicable rules. If the customer is subject to sale restrictions due to governmental measures regarding some sales products presented on the Website, he/she commits to not order it. Furlan Marri reserves the right to refuse the order if they have any doubt. The customer agrees to have Furlan Marri using the personal data provided by the customer in the process of the Order to carry out appropriate sale due diligence.
   8. The customers are responsible for providing accurate and correct personal information for delivery and sale. All changes must be sent to support@furlanmarri.com. For direct order product, the customer delivery information (shipping address, contact information) can no longer be updated 10 hours after ordering. For pre-order products, the customer delivery information (shipping address, contact information) can only be updated until the end of the pre-order period. After this period, as we use an automatic fulfilment center, the item will be processed for picked, packed and delivered.

1. Payment prices and terms
   1. The prices will be in Swiss francs. These prices are exclusive of tax for exports and VAT, except for Swiss residents while ordering "swiss made mechanical watches (Three Hands Story as an example)" for which the VAT will be added and paid at the time of the order. The customer is responsible for the customs import duties, VAT or any related taxes applicable in his country, and should be aware before purchasing (European Union customers included, Switzerland is not part of the European Union). We ship our watches either from Hong Kong for Mecaquartz watches, Switzerland for Swiss made watches but can also be shipped from different warehouses in the world. Local duties and VAT are due upon the delivery of our watches and this will depends on your country (Switzerland is not part of the European Union). It's a normal process that e-commerce brands have, as they don't have boutiques to include or charge local taxes. For example, France customers will have to pay about 20% more or less, India can be up to 48% and Switzerland 8,1%. USA have a treshold of USD 800. If the customer don't want to pay the taxes, the product will be returned to us and we will have to deduct those fees from the refund, as local government taxes cannot be refunded. Please make sure of your decision before refusing to pay government taxes an duties, as sometimes it can be more appropriate to keep the product.. Depending on the country the Website is visited from, the currency may be different. However, payments will always be made in Swiss Francs. Price differences may appear on the product page and the invoice, according to the exchange rate of the day. However, we will still charge in CHF (Swiss Francs).
   2. Furlan Marri reserves the right to change their prices at any given time. The prices charged to customers are the prices that are published on the site on the days of the order.
   3. The payment can be made either by debit card, credit card and Apple Pay.
   4. The payment shall be made upon order. If, for any reason, the payment is refused, the order will be automatically cancelled.

1. Delivery terms and conditions
   1. In general, the delivery time is between 5 to 15 days, unless otherwise specified in the offer. The delivery time is given as an estimation only and is not binding. Depending on the country of delivery, it may take more time due in particular to customs inspections. Furlan Marri will not be liable for any delay due to an extension of the delivery deadline.
   2. Furlan Marri offers the shipping cost.
   3. All products will be shipped worldwide, with insurance and tracking references. We are not responsible for any import permit fees and/or other fees that couriers may add.
   4. In the event some of the ordered products are not available, Furlan Marri is entitled to make partial deliveries.
   5. In the event the product could not be delivered due to the customer’s fault, Furlan Marri is entitled to withdraw from the contract after two delivery attempts. In this case, any payments made will be refunded, subject to deduction of delivery costs and any others costs Furlan Marri had to bear in connection with the return of the product.
   6. In the event the product could not be delivered due to the customer non-payment of customs fees, permit fees due to the remote or out of town area or if customs refuse the product for whatever reason, Furlan Marri is entitled to withdraw from the contract. Any payments made will be refunded, subject to deduction of delivery costs and all others costs Furlan Marri had to bear in connection with for the return of the product.
   7. Some shipping restrictions may occur with regard to certain national regulations. Before ordering, the customer shall make sure that there are no shipping restrictions in his/her country. Furlan Marri is not liable for any delivery problem due to national restrictions. If delivery is made impossible due to national restrictions, the order will be cancelled. The price will be refunded subject to deduction of delivery and any other fees. Furlan Marri does not deliver to P.O. boxes and such orders can be cancelled (some couriers cannot deliver to P.O. Boxes).
   8. Due to shipping carriers restrictions area, some destinations are not covered, therefore we are not able to ship our products in those specific areas. You can access the full list of restricted countries by FedEx Express here (https://www.fedex.com/en-ch/shipping/served-countries.html). There are some restrictions also for Ukraine and Russia, our shipping carriers cannot currently ship our goods there.

1. Transfer of property

The product remains Furlan Marri’s property until it has been fully paid for and delivered to the customer. Pledging, assignment by way of security, transformation or modification shall not take place prior to Furlan Marri’s transfer of ownership and without Furlan Marri’s consent.

1. Right of withdrawal
   1. Customers have the right to withdraw from the contract within 14 days following receipt of the products. The withdrawal declaration must be notified in writing via Furlan Marri’s e-mail address. The dispatch date of the withdrawal declaration is relevant for compliance with the deadline. It is not necessary to state the reasons for cancellation. The withdrawal declaration must be sent to: support@furlanmarri.com
   2. The withdrawal right is exercised in such a way that the sales contract is transformed into a cancellation, with the return of the services received under the contract. The customer is obliged to return the received product to Furlan Marri in the original packaging, the protective sticker on the glass of the watch must still be present, together with all supplied accessories (including straps, accessories, packaging, certificate of origin and all other papers), without any trace of use, and within 14 days from the withdrawal declaration to Furlan Marri. The returning costs of the watch are to be supported by the customer. Without all these conditions, the product has no resale value for a new customer.
   3. You must use a trackable shipping service and purchase shipping insurance. If you do not use a tracking service and purchase a shipping insurance and that the product is lost, Furlan Marri will not refund you.
   4. Once paid, the purchase price shall be immediately refunded to the customer, less the return costs upon receipt and inspection of the products, subject to a deduction from the price to be refunded in case of damage to the product or excessive wear and tear. Furlan Marri has the right to hold the refund until the product has been returned or until the customer provides proof that the goods have been returned, whichever comes first.
   5. Withdrawal rights are not applicable to limited edition watches and it will be communicated as such on the Website. This exception is due to the fact that limited editions are only sold for a specific period of time and cannot be sold again after a potential return. Pre-orders limited by time cannot be refund after the pre-order selling period, due to the fact that we need to produce the watches with the funds received. However, our customers have the right to be refunded before the end of the pre-order period.

1. Warranty and liability
   1. Furlan Marri guarantees that the products comply with the promised qualities, are free from defects that may affect their value or fitness for purpose and that they correspond to the intended performance and specifications.
   2. Furlan Marri provides the customer with a warranty against manufacturing defects or hidden defects within 2 years as from the date of delivery of the product. Any claim for manufacturing defects or hidden defects must be submitted within 48 hours from the date of delivery of the Products or, in case of hidden defects, from their discovery. Our customer service is available at support@furlanmarri.com.
      A manufacturing defect and/or a hidden defect notified in the above mentioned delay shall allow for the replacement or reparation of the defective product or a refund of the paid price, at Furlan Marri’s sole discretion, by Furlan Marri and at Furlan Marri’s costs (except the shipping cost of the defective product to Furlan Marri which shall be at the customer’s cost).
      The customer must then return the damaged or defective product to Furlan Marri (in its original packaging), to the address that Furlan Marri will communicate at a later stage.
   3. Furlan Marri shall not be liable for any damage caused by a misuse of a product. Excessive shocks or vibrations, exposure to strong electromagnets and similar activities can cause damage to or affect the functions. If you are uncertain if a particular activity is safe for the watch, please e-mail us at support@furlanmarri.com.
   4. You must use a trackable shipping service and purchase shipping insurance. If the product is lost, due to the fact that you do not use a tracking service and do not purchase a shipping insurance, Furlan Marri will not refund you.
   5. The warranty does not include straps and accessories.

1. Disclaimer

Despite all the care taken in preparing the Website, it may contain inaccurate or incomplete information. Furlan Marri is not responsible for any errors or omissions in the images or descriptions of the products on the Website. Furlan Marri shall not be liable for any direct or indirect damage resulting from interruptions of the Website, from the occurrence of bugs hindering the navigation of the Website or from any other technical problems (including the possible presence of viruses or other harmful elements). Furlan Marri accepts no responsibility for the content of third-party websites that may be accessible from the Website or linking to their Website by means of hyperlinks. Furlan Marri has no control over the content of these external sites.

1. Force majeure

Furlan Marri shall not be liable for failure to execute an order due to force majeure. Force majeure is any circumstance beyond the control of Furlan Marri, including, but not limited to, major business disruptions, accidents, labour disputes, late or defective deliveries of raw materials or semi- or fully manufactured products, restrictions imposed by the authorities, epidemics, pandemics, fires, floods or other natural disasters.

When you create a customer account on the Website, you are asked to provide us with information about yourself, such as your name, email address, billing address, delivery address and payment details. You agree to provide us with accurate and complete information. You also send us personal data when you send us a message via the contact form available on the Website or by email. Furlan Marri undertakes to confidentially treat your personal data. Please refer to our Privacy Policy for information on how Furlan Marri collects, uses and protects your personal data.

1. Intellectual Property

Furlan Marri brand is a protected trademark and cannot be used and reproduced without Furlan Marri’s express written consent. The content and structure of the products displayed by Furlan Marri, as well as the entire internet offers, are protected by copyright. The use of articles and work tools for personal use by the customer is permitted, however their commercial distribution in part or whole requires the express permission of Furlan Marri.

1. Place of jurisdiction and applicable law

The contractual relationship between the customer and Furlan Marri is subject to Swiss substantive laws, excluding the provisions of the United Nations Convention of 11 April 1980 on the International Sale of Goods. The competent court of Geneva is competent for all disputes arising from this contract.

1. Final provisions

Should individual provisions of these general terms and conditions be ineffective, the validity of the remaining provisions shall not be affected.
